Dili, 24 March 2011 - Pillay: Fight impunity by protecting the right to the truth about gross human rights violations.
Statement by the High Commissioner for Human Rights Navi Pillay on the International Day for the Right to the Truth concerning Gross Human Rights Violations and for the Dignity of Victims .
Forty-two thousand six hundred and thirty-three -- this is the number of cases, of people who have disappeared and remain unaccounted for over the past 31 years, under consideration by the Working Group on Enforced
or Involuntary Disappearances. Figures also show that new cases continue to emerge from all regions of the world on a regular basis. For every one of those individuals, there are many loved ones agonising over their fate, alternating between hope and despair and waiting for news – any news.
Victims of gross violations of human rights and their families have the inalienable right to know the truth about past events concerning the perpetration of heinous crimes against them. They have the right to know about the circumstances and reasons that led, through massive or systematic violations, to the perpetration of those crimes. They have the right to know who the perpetrators are, and the fate and whereabouts of the victims. In recognition of the right of all these victims, the United Nations has declared today to be the International Day for the Right to the Truth concerning Gross Human Rights Violations and for the Dignity of Victims.
A people's knowledge of the history of its oppression is part of its heritage. Knowing the truth allows victims and relatives to gain a sense of closure, some restoration of dignity and receive acknowledgement of their suffering. The truth is a tool to combat impunity. It is a tool for justice. And it is a vital step in preventing a recurrence of the
events that led to the violations.
It is for these reason that it is so important to bring the truth to light, including through public, independent and impartial inquiries into gross violations such as torture, rape, sexual slavery, disappearances and killings that we are currently witnessing in so many countries. In recent years, my office has supported a number of fact-finding missions and commissions of inquiry into reports of gross violations in a number of countries, including the one on Libya, which was created by the Human Rights Council last month.
In marking this day, we also pay tribute to the brave women and men who have taken, and continue to take, great risks to ensure that the truth is told about human rights violations in their countries. These human rights defenders often fear reprisals but nevertheless discharge what they perceive as their duty with great courage. Many have been arrested or face worrying and alarming incitement to violence due to their cooperation with international human rights mechanisms, including my office.
Indeed this date was chosen to commemorate one such human rights defender, Monsignor Óscar Arnulfo Romero, who was shot dead in 1980 while celebrating mass in a chapel in El Salvador. Monsignor Romero was killed for his outspoken condemnation of the violations being committed against the most vulnerable populations in his country.
On this day, I call on all states to take all appropriate measures to give effect to the right to the truth, the right to justice and the right to reparations. These three indispensable rights are at the core of the fight against impunity and the restoration of the dignity of victims. Let this international day be a reminder of the existence and the importance of the right to the truth. Let it also be a reminder of the need to protect those who dedicate their lives to telling it.

Pillay: combater a impunidade protegendo o direito à verdade sobre as violações graves de direitos humanos
Declaração da Alta Comissária para os Direitos Humanos, Navi Pillay, no Dia Internacional para o Direito à Verdade em relação às Graves Violações de Direitos Humanos e a Dignidade das Vítimas.
Quarenta e dois mil seiscentos e trinta e três. Este é o número de casos de pessoas que desapareceram e continuam desaparecidos nos últimos 31 anos, segundo o Grupo de Trabalho sobre Desaparecimentos Involuntários ou Forçados. Os números mostram também que novos casos continuam a surgir constantemente de todas as regiões do mundo. Para cada um desses indivíduos, existem muitos entes queridos a sofrer pelo seu paradeiro, passando da esperança ao desespero, à espera de notícias. De qualquer notícia.
As vítimas de violações graves dos direitos humanos e as suas famílias têm o direito inalienável de conhecer a verdade com relação aos acontecimentos passados sobre a perpetração de crimes odiosos contra eles. Eles têm o direito de saber sobre as circunstâncias e os motivos que levaram, através de violações massivas e sistemáticas, à perpetração desses crimes. Eles têm o direito de saber quem são os autores, além do paradeiro das vítimas. Reconhecendo os direitos de todas estas vítimas, as Nações Unidas escolheram hoje como o Dia Internacional para o Direito à Verdade em relação às Graves Violações de Direitos Humanos e a Dignidade das Vítimas.
O conhecimento dos povos sobre a história da sua opressão faz parte da sua herança. Conhecer a verdade permite que as vítimas e os seus parentes obtenham um sentimento de encerramento do processo, uma certa restauração da sua dignidade e o reconhecimento do seu sofrimento. A verdade é uma ferramenta para combater a impunidade. É uma ferramenta para a justiça. E é um passo vital na prevenção da recorrência dos eventos que conduziram à violação.
Por essas razões, é importante revelar a verdade por meio de inquéritos públicos, independentes e imparciais, sobre graves violações como tortura, violação sexual, escravidão sexual, desaparecimentos e assassinatos a que testemunhamos actualmente em tantos países. Nos últimos anos, o meu escritório tem apoiado uma série de missões de apuramento de factos e de comissões de inquérito para investigar relatos de violações em vários países, incluindo a comissão na Líbia, criada pelo Conselho de Direitos Humanos no mês passado.
Marcando este dia, também prestamos homenagem aos valentes homens e mulheres que tomaram e continuam a tomar grandes riscos para garantir que a verdade seja dita sobre as violações dos direitos humanos nos seus países. Estes defensores dos direitos humanos muitas vezes temem represálias, mas, no entanto, cumprem com o que consideram ser o seu dever com grande coragem. Muitos foram presos ou sofreram preocupantes e alarmantes incitamentos à violência devido à sua cooperação com os mecanismos internacionais de direitos humanos, incluindo o meu escritório.
De fato, esta data foi escolhida para relembrar um desses defensores dos direitos humanos, Óscar Arnulfo Romero, que foi baleado e morto em 1980 enquanto celebrava a missa numa capela em El Salvador. Monsenhor Romero foi assassinado pela sua forte condenação das violações cometidas contra a população mais vulnerável
do seu país. Neste dia, exorto todos os Estados a tomarem todas as medidas adequadas para fazer efectivo o direito à verdade, o direito à justiça e o direito à reparação. Estes três direitos indispensáveis estão no centro da luta contra a impunidade e da restauração da dignidade das vítimas. Que este dia internacional sirva de lembrança da existência e da importância do direito à verdade. Que sirva também de lembrança da necessidade de proteger aqueles que dedicam as suas vidas para contar a verdade.FIM
